1. Acceptance and eligibility
These Terms of Service (the “Terms”) are a binding agreement between you and WindOp, operated by Unknown Projects (“WindOp,” “we,” “us,” or “our”). They govern your use of windop.app, the WindOp Windows desktop application, accounts, subscriptions, APIs, downloads, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy.
You must be legally able to enter into this agreement. If you use WindOp for an organization, you represent that you have authority to bind it. Users under 13 may not use the Services. Where local law requires a higher minimum age or parental consent, that requirement applies.
2. What WindOp does
WindOp is an AI-powered Windows operator. Depending on the features you enable, it can communicate with AI model providers, create or modify files, run shell or PowerShell commands, control desktop applications, capture or analyze screens, connect to third-party tools and MCP servers, manage scheduled tasks, and operate integrations such as Discord.
Some features run locally. Others require internet access or third-party services, including AI model providers, OpenRouter, authentication, billing, cloud sync, or connected integrations. Feature availability can vary by plan, configuration, region, provider availability, and software version.
3. License and software use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the WindOp application for lawful personal or internal business purposes. Open-source components remain governed by their respective licenses.
You may not sell, sublicense, rent, or commercially redistribute the Services; bypass usage, plan, security, or access controls; interfere with the Services; introduce malware; scrape non-public systems; or reverse engineer proprietary portions except where applicable law expressly permits it.
4. Accounts and security
Certain features require an account. You must provide accurate information, protect your credentials and devices, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless caused by our breach of these Terms or applicable law.
You are also responsible for safeguarding provider keys, integration tokens, and other credentials you supply. Do not share secrets in prompts or workflows unless necessary and you understand where that information will be sent.
5. Computer control and your responsibility
WindOp can take actions with real consequences. You control which permissions, tools, folders, commands, integrations, and confirmation settings you enable. You are responsible for reviewing proposed actions, maintaining backups, testing workflows in a safe environment, and supervising actions that could affect files, accounts, software, networks, purchases, communications, or other people.
Do not use WindOp as the sole basis for medical, legal, financial, safety-critical, employment, housing, credit, law-enforcement, weapons, or other high-impact decisions. Never grant the application more access than needed. AI output and automation may be incomplete, inaccurate, unexpected, or destructive.
6. AI output and third-party services
WindOp may send your prompts, attachments, tool context, and other request data to the AI provider or integration you select. When you bring your own API key, your relationship with that provider is also governed by its terms and privacy policy. Managed plans may route eligible AI requests through WindOp’s service and OpenRouter to the selected model provider.
We do not guarantee that AI output is accurate, unique, lawful, non-infringing, secure, or suitable for a particular purpose. You must evaluate output before relying on, publishing, executing, or distributing it. Third-party services are operated by others, and we are not responsible for their availability, changes, content, or conduct.
7. Your content and feedback
You retain the rights you have in prompts, files, messages, configurations, and other content you provide (“Your Content”). You grant us a limited license to host, transmit, process, reproduce, and secure Your Content only as needed to provide, maintain, protect, and improve the Services you use, comply with law, and enforce these Terms.
You represent that you have the rights and permissions needed to use Your Content with the Services. If you send feedback, you allow us to use it without restriction or compensation, provided we do not publicly identify you without permission.
8. Plans, trials, billing, and credits
Paid features may be offered as subscriptions, usage balances, or credit packs. Prices, included usage, renewal periods, and plan features are shown at checkout. Taxes may apply. Payments are processed by Stripe; we do not store full payment card numbers.
Subscriptions renew automatically until canceled. You may cancel through the available account or billing portal; cancellation normally takes effect at the end of the current paid period. Trial eligibility and duration may be limited, and a trial may convert to a paid subscription if disclosed at signup. Promotional or included usage credits may expire or reset as described with the applicable plan.
Except where required by law or expressly stated at purchase, charges are non-refundable once a billing period or credit purchase begins. If you believe a charge is incorrect, contact support@windop.app promptly.
9. Acceptable use
You may not use the Services to:
- violate law, sanctions, court orders, or another person’s rights;
- access systems, accounts, or data without authorization;
- create, distribute, or facilitate malware, credential theft, spam, fraud, abuse, or harmful deception;
- harass, exploit, threaten, or unlawfully surveil people;
- circumvent security, rate limits, payment controls, or provider safeguards;
- disrupt the Services or impose an unreasonable load on our infrastructure; or
- use output or automation in a manner that is illegal or materially harmful.
Security research must be authorized and responsibly disclosed to security@windop.app. We may investigate abuse and restrict access when reasonably necessary to protect users, third parties, or the Services.
10. Changes, beta features, and availability
We may add, modify, suspend, or discontinue features, integrations, models, limits, or plans. Beta, preview, and experimental features may be unstable, change without notice, or lose data. We do not promise uninterrupted availability, compatibility with every device or provider, or permanent access to any particular model or feature.
11. Suspension and termination
You may stop using WindOp at any time and may request account deletion by contacting support@windop.app. Self-service deletion controls may not yet be available. We may suspend or terminate access if you materially breach these Terms, create legal or security risk, fail to pay amounts due, or misuse the Services. Where practical, we will provide notice and an opportunity to resolve the issue.
Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, limitations of liability, and dispute terms—will survive.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND UNINTERRUPTED AVAILABILITY. We do not warrant that AI output, automation, downloads, integrations, or third-party services will be error-free or meet your requirements. Nothing in these Terms excludes warranties that cannot legally be excluded.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINDOP AND UNKNOWN PROJECTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, OR SECURITY, ARISING FROM OR RELATED TO THE SERVICES—even if advised such damages are possible.
Our aggregate liability for claims relating to the Services will not exceed the greater of (a) the amount you paid us for the Services during the 12 months before the event giving rise to the claim or (b) US $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
14. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless WindOp, Unknown Projects, and their contributors and service providers from third-party claims, damages, and reasonable costs arising from your unlawful use of the Services, Your Content, your breach of these Terms, or your violation of another person’s rights.
15. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes that cannot be resolved informally will be brought in the state or federal courts serving York County, Pennsylvania, and each party consents to their jurisdiction.
Before filing a claim, please email support@windop.app and give us 30 days to try to resolve it. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims court.
16. General terms and changes
These Terms and incorporated policies are the entire agreement about the Services. If one provision is unenforceable, the remainder stays effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, or transfer of the Services.
We may update these Terms. We will change the effective date and, for material changes, provide reasonable notice through the website, application, account email, or another appropriate channel. Continued use after the updated Terms take effect means you accept them.
