Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and WindOp, operated by Unknown Projects (“WindOp,” “we,” “us,” or “our”). They govern your use of windop.app, the WindOp desktop application, accounts, subscriptions, APIs, downloads, and related services (the “Services”). By using the Services you agree to these Terms and our Privacy Policy. If you do not agree, please do not use them.

You must be at least 13 years old, and old enough under your local law to form a binding contract, or have a parent or guardian agree for you where that is permitted. If you use WindOp for an organization, you confirm you have authority to bind it. You may not use the Services if you are barred from receiving them under applicable law, including U.S. export controls and sanctions.

WindOp is an AI-powered desktop operator. Depending on the features you enable, it can send requests to AI providers, create or modify files, run shell or PowerShell commands, control desktop applications, capture and analyze screens, connect to third-party tools and MCP servers, run scheduled tasks, and operate integrations such as Discord.

Some features run entirely on your device. Others need internet access or third-party services, including AI providers, OpenRouter, authentication, billing, sync, or connected integrations. Availability varies by plan, configuration, region, provider, and software version.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the WindOp application for lawful personal or internal business purposes. We and our licensors keep all rights not expressly granted. Open-source components remain under their own licenses, which prevail for those components.

You may not sell, sublicense, rent, or commercially redistribute the Services; bypass usage, plan, security, or access controls; interfere with or overload the Services; introduce malware; scrape non-public systems; or reverse engineer proprietary parts, except where applicable law expressly permits it despite this restriction.

Some features need an account. Give accurate information, protect your credentials and devices, and tell us promptly about suspected unauthorized access. You are responsible for activity under your account unless it results from our breach of these Terms or of law. Managed AI is provisioned per account, and you may not share, resell, or pool account access or credits.

You are also responsible for the provider keys, integration tokens, and other credentials you supply. Avoid putting secrets in prompts or workflows unless necessary and until you understand where the information will be sent.

WindOp can take actions with real consequences. You control the permissions, tools, folders, commands, integrations, and confirmation settings you enable. You are responsible for reviewing proposed actions, keeping backups, testing workflows safely, and supervising anything that could affect files, accounts, software, networks, purchases, communications, or other people.

Do not rely on WindOp as the only basis for medical, legal, financial, safety-critical, employment, housing, credit, law-enforcement, or other high-impact decisions. Grant only the access a task needs. Automation and AI output can be incomplete, inaccurate, unexpected, or destructive, and you are responsible for how you use them.

WindOp sends your prompts, attachments, tool context, and other request data to the AI provider or integration you select. If you use your own API key, that provider’s terms and privacy policy also apply. If you use a Claude Code or Codex subscription, WindOp runs the official program installed on your PC under your own account, and Anthropic’s or OpenAI’s terms apply to that use; WindOp is not affiliated with or endorsed by those companies. Managed plans route eligible requests through WindOp’s service and OpenRouter to the model provider you choose.

We do not guarantee that AI output is accurate, unique, lawful, non-infringing, secure, or fit for a purpose. Evaluate it before relying on, publishing, running, or distributing it. As between you and us, and to the extent the law allows, you own the output you generate, though similar output may be produced for others and providers’ terms may add conditions. Third-party services are run by others, and we are not responsible for their availability, changes, content, or conduct.

You keep whatever rights you have in the prompts, files, messages, configurations, and other material you provide (“Your Content”). You grant us a limited license to host, transmit, process, reproduce, and secure Your Content only as needed to provide, maintain, and protect the Services you use, to comply with law, and to enforce these Terms. We do not use your private desktop content to train our own general-purpose AI models.

You confirm that you have the rights and permissions to use Your Content with the Services, including any personal information of others you choose to process. If you send feedback, you allow us to use it without restriction or compensation, and we will not publicly name you without your permission.

The desktop application is free to use with your own provider keys. Paid features, including managed AI access, may be offered as subscriptions, prepaid credits, or credit add-ons. Some plans may be offered by waitlist before they open. The price, included usage, billing period, renewal terms, and cancellation method are shown to you before you pay. Taxes may apply. Stripe processes payments, and we never receive or store your full card number.

Refunds. Except where the law requires otherwise or we state otherwise at purchase, charges are non-refundable once a billing period or credit purchase begins. If you were charged in error, were charged after canceling, or did not expect a renewal, email [email protected] promptly and we will review it in good faith. If a payment is refunded or successfully disputed, we may remove the matching credit balance and suspend managed access until the matter is resolved. Opening a dispute with your card issuer instead of contacting us may delay resolution.

Price changes. We may change prices or plan terms going forward, and will give notice before the change affects your next renewal. You can cancel before it takes effect.

Your statutory rights. Some places, including California and certain other U.S. states, have automatic-renewal laws, and some countries give consumers cancellation or withdrawal rights. Nothing in these Terms limits rights you have under those laws.

You may not use the Services to:

• violate law, sanctions, court orders, or another person’s rights;
• access systems, accounts, or data without authorization;
• create, spread, or help others create malware, credential theft, spam, fraud, or harmful deception;
• harass, exploit, threaten, or unlawfully surveil people, or generate sexual content involving minors;
• circumvent security, rate limits, payment controls, or provider safeguards, or misuse another person’s API keys or accounts;
• disrupt the Services or impose an unreasonable load on our infrastructure; or
• use output or automation in a way that is illegal or materially harmful.

AI providers also enforce their own usage policies, and a request that violates them may be refused or your access may be limited. Security research must be authorized and reported responsibly to [email protected]. We may investigate abuse and restrict access where reasonably necessary to protect users, third parties, or the Services.

WindOp’s name, logo, software, website, and documentation are owned by Unknown Projects or its licensors and protected by intellectual-property laws. These Terms give you no ownership in them. If you believe content on the Services infringes your copyright, email a notice with the information required by 17 U.S.C. § 512(c)(3) to [email protected], and we will review it and respond as the law requires.

We may add, change, suspend, or discontinue features, integrations, models, limits, or plans. Beta, preview, and experimental features, including cloud sync and backup, may be unstable, change without notice, or lose data, so keep your own backups. We do not promise uninterrupted availability, compatibility with every device or provider, or permanent access to any particular model or feature.

You may stop using WindOp at any time and may ask us to delete your account by emailing [email protected]; self-service deletion is still being built. We may suspend or end your access if you materially breach these Terms, create legal or security risk, fail to pay amounts due, or misuse the Services. Where practical, we will give notice and a chance to fix the problem first.

Sections that by their nature should survive termination, including ownership, payment obligations, disclaimers, limits of liability, and dispute terms, will survive.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND UNINTERRUPTED AVAILABILITY. We do not warrant that AI output, automation, downloads, integrations, or third-party services will be error-free or meet your requirements. Some jurisdictions do not allow certain disclaimers, and nothing in these Terms excludes warranties or rights that cannot legally be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINDOP AND UNKNOWN PROJECTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED THEY ARE POSSIBLE.

OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited, such as for fraud, gross negligence, or willful misconduct in places where the law does not allow limiting it.

To the extent permitted by law, you will defend, indemnify, and hold harmless WindOp, Unknown Projects, and their contributors and service providers from third-party claims, damages, and reasonable costs arising from your unlawful use of the Services, Your Content, your breach of these Terms, or your violation of another person’s rights. This does not apply where the law prohibits it.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes we cannot resolve informally will be brought in the state or federal courts serving York County, Pennsylvania, and each party consents to their jurisdiction. If you are a consumer, you keep any mandatory protections of the law of the place where you live.

Before filing a claim, please email [email protected] and give us 30 days to try to resolve it. Nothing here stops either party from seeking urgent injunctive relief or using an eligible small-claims court. To the extent the law allows, claims must be brought individually and not as a class or representative action.

These Terms and the policies they reference are the entire agreement about the Services. If a provision is unenforceable, the rest stays effective. Not enforcing a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in a reorganization, financing, or transfer of the Services. No third party has rights under these Terms. Notices to you may be given by email, in the app, or on the website.

We may update these Terms. We will change the effective date and, for material changes, give reasonable notice on the website, in the app, or by email, and, for subscribers, before the change applies to your next renewal. Continuing to use the Services after updated Terms take effect means you accept them; if you do not, stop using the Services and cancel any subscription.
